Essential Recording Requirements
Acknowledgements: To entitle any conveyance, mortgage, or instrument of writing to be recorded.
Legibility of Names: Typed or printed under each signature exactly as signed, and consistently in the same form through the instrument.
Name of Person Preparing Instrument: Each document effecting real estate.
Notarized Documents: Requires county of residence of notary and commission expiration, State seal, and notary name in printed from beneath signature of notary.
Transfer of Deeds for Taxation: Endorsement by Auditor, and be accompanied by a completed Indiana Disclosure of Sales form, before recording.
Release or Satisfaction of Liens: May be executed by President, Vice President. Cashier, Secretary, Treasurer, General manager, or Attorney-in-fact (if P.O.A. is used, it must be recorded and made reference to by placing the recording information on the face of the instrument in which it has been used).
As of January 1, 2005 we no longer accept hand written deeds or surveys larger than 18 X 24 to be recorded.
Social Security Number Redaction: As of July 1, 2006 every recorded document must include these words after the prepared statement at the conclusion of the document:
“I affirm, under the penalties for perjury, that I have taken reasonable care to redact each Social Security number in this document, unless required by law (insert your name).”
The language cannot be altered in any way, shape, or form. It must use those words, and it must appear at the conclusion of the document.
